Section Hum 307.03 - Vacation or Modification of Subpoena

(a) Any recipient of a subpoena may petition the commission to vacate or modify a subpoena issued in its name.
(b) The commission shall give prompt notice to the party, if any, who requested issuance of the subpoena, and such party shall have the opportunity to respond within a time limit set by the presiding officer.
(c) The presiding officer shall grant the petition in whole or part upon a finding that:
(1) The testimony sought, or the evidence
required to be produced, does not relate to any matter in question in the
hearing;
(2) The subpoena for the
production of evidence is unreasonable and oppressive; or
(3) The subpoena was issued so close in time
before the hearing for which the testimony or evidence is sought that the
recipient is unable to comply with it.
