Section Hum 305.03 - Decisions on Motions for Continuance and Rescheduling

(a) Motions for continuance and rescheduling shall be granted for good cause, including:
(1) Illness or injury which
prevents a party or other participant in the proceedings from timely:
a.Preparing and making required
filings;
b.Preparing for a
pre-hearing conference or hearing; or
c.Participating in a pre-hearing conference
or hearing.
(2) A
scheduled hearing in another tribunal which:
a.Requires the attendance of the proponent of
the motion or of the attorney for the motion's proponent, for which there is
nobody who could reasonably substitute for the proponent or the proponent's
attorney;
b.Can not be postponed;
and
c.Prevents timely:
1.Preparation and filing of required
documents;
2.Preparation for a
pre-hearing conference or hearing; or
3.Participation in a pre-hearing conference
or hearing;
(3) Temporary unavailability of material
required to be filed, despite the due diligence of the party responsible for
the filing;
(4) Severely inclement
weather; or
(5) Such other reasons
beyond the control of the proponent of the motion or the commission that
warrant a continuance and rescheduling of the original deadline or date in the
interest of justice and efficiency.
