Universal Citation: NH Admin Rules He-W 634.01

(a) If an individual is participating in a strike, as defined in He-W 601.162, the individual shall be denied NHEP/FAP financial assistance, regardless of whether the individual:

(1) Voted for or against the strike, or

(2) Is exempt from NHEP work participation requirements.

(b) The following individuals shall not be considered strikers:

(1) Individuals whose work place is closed due to a lockout by an employer to resist demands of employees;

(2) Individuals unable to work as a result of other employees on strike; or

(3) Individuals not wanting to cross a picket line due to fear of personal injury or death.

(c) Individuals who quit their jobs or are fired while on strike shall be treated like any other applicant or recipient for NHEP/FAP financial assistance who has quit or been fired from employment.

(d) Participation in a strike shall not affect eligibility for NHEP/FAP medical assistance.
