(a) The department shall impose enforcement actions for violations of RSA 143, RSA 143-A, or He-P 2300, including the following:
(1) Imposing fines upon an applicant,
licensee, or unlicensed individual;
(2) Denying a license application;
(3) Revoking a license; or
(4) Immediately closing the food
establishment pursuant to
He-P 2306.06.
(b) When imposing a fine, denying a license application, or revoking a license, the department shall send to the applicant or licensee a written notice that sets forth:
(1) The action to be taken by the
department;
(2) The reasons for the
action, including the identification of each deficiency as applicable;
and
(3) The right of the applicant
or licensee to request a hearing in accordance with RSA 541-A, He-C 200, and
He-P
2306.04 prior to the enforcement action becoming
final.
(c) No ongoing enforcement action shall preclude the imposition of any remedy available to the department under RSA 143, RSA 143-A, RSA 541-A:30, III, or He-P 2300.
