(a) If the original determination of the investigation is upheld, a notice shall:
(1)
Be sent within 5 business days of the reconsideration to the perpetrator and
the perpetrator's guardian, if any, or to the victim of self-neglect and the
guardian of the victim of self-neglect, if any; and
(2) Contain an explanation of why the
determination was upheld.
(b) If the original determination of the investigation is overturned, notice shall be sent within 5 business days of the reconsideration to:
(1) The perpetrator and
the perpetrator's guardian, if any, or to the victim of self-neglect and the
guardian of the victim of self-neglect, if any; and
(2) The victim of a founded report of abuse,
neglect, or exploitation and the victim's guardian, if any.
(c) The 5 business day decision period stipulated in (a) and (b) above shall only be extended with the agreement of:
(1) The alleged perpetrator and
the alleged perpetrator's guardian, if any; or
(2) The alleged victim of a founded report of
self-neglect and the guardian of the victim of self-neglect, if any.
