In order to be eligible to receive ADRD respite care services, the primary caregiver shall reside with an individual who:

(a) Is an adult, who is unable to attend to daily needs without the assistance or regular supervision of a primary caregiver;

(b) Has a documented physician's diagnosis of ADRD based on the diagnostic criteria contained in the Diagnostic and Statistical Manual of Mental Disorders, Fourth Edition, Text Revision (DSM-IV-TR), July 2000;

(c) Receives care 24 hours a day from the primary caregiver, who is not paid to provide the care; and

(d) Does not receive respite services under the following programs:

(1) A long-term care insurance program that provides respite services;

(2) The choices for independence (CFI) program pursuant to He-E 801;

(3) The medicaid-covered home and community-based care waiver services for persons with developmental disabilities and acquired brain disorders pursuant to He-M 517, He-M 522, and 524; or

(4) The Veterans Administration.
