(a) Providers providing Title XX services may charge fees to individuals receiving these services under the conditions described in this section.
(b) Providers that elect to charge fees shall:
(1) Develop a sliding fee schedule;
(2) Provide the fee schedule to
individuals in a letter that describes:
a.
The basis for the fee;
b. A
description of the program the fee is being applied to;
c. A description of how the fee applies based
on the individual's income;
d. The
billing schedule, as applicable; and
e. Whether or not and when services would be
discontinued for non-payment; and
(3) Include with the letter to the
individual, in (2) above, a copy of the sliding fee schedule.
(c) Providers shall base sliding fee schedules on the following considerations:
(1) The type of program(s) the fee is being
applied to;
(2) The ability of the
individual to pay the fee which includes the income of the individual receiving
Title XX services; and
(3) The fee
does not exceed the difference between the amount reimbursed by the department
to providers and the standard payment charged to individuals paying privately
for the full cost of services provided by the provider.
(d) Providers shall:
(1) Communicate the fee schedule verbally and
in writing prior to commencing services; and
(2) Make available fee and billing
information at any time.
(e) No fees shall be charged to the client receiving Title XX services when the department has determined that services are needed for protective reasons in accordance with RSA 161-F:42-57.
