(a) The division shall attend meetings of the special education evaluation team and participate in any decisions made at team meetings if:

(1) Invited to the team meeting by a parent of a student who is or might be educationally disabled or by the legally liable school district;

(2) Informed by the parent or legally liable school district in writing of the date and time of the team meeting;

(3) The employee of the division assigned to the student's case is available to attend; and

(4) The division's attendance is necessary to effectuate the division's case plan for the student.

(b) The division shall cooperate with the special education evaluation team and assist the team in its evaluation of the student, including providing the team with access to educational records and those portions of any court-ordered evaluations of the student that are relevant to the team's evaluation of the student, in the possession of the division upon request by the team, whether or not a representative of the division attends and participates in the meetings of the team.
