Section He-C 6443.05 - Notice to Legally Liable School Districts: Non-Emergency Residential Placements of Students Who Are or Might Be Educationally Disabled

(a) Except in an emergency, when the division has reason to know that it will recommend that a student who is or might be educationally disabled be placed in a residential facility, or that it will recommend that the student's present residential placement be changed, the division shall give written notice to the legally liable school district on "Form Notice that Placement May Be Changed".

(b) Except in an emergency, when the division has reason to know that the state court having jurisdiction over a student who is or might be educationally disabled will order the student to be placed in a residential facility or will order that the student's present residential placement be changed, the division shall give written notice to the legally liable school districts "Form Notice that Placement May Be Changed".

(c) The written notice required under (a) or (b) above shall contain:

(1) The name of the student;

(2) The name and address of the student's present placement;

(3) The name of the sending and receiving districts for the student's present placement;

(4) The name and address of placement or prospective placements under consideration;

(5) The date of placement or date of prospective change in placement; and

(6) The reasons for placement or the change in placement.
