Section He-C 6443.01 - Purpose

(a) The rules in this part are intended to describe the procedures to be followed by the division for children, youth and families in providing notice and information to school districts and the department of education in cases where children or students who are or might be educationally disabled are placed in residential programs pursuant to RSA 169-B, 169-C, 169-D, 170-C or 463.

(b) These rules are intended to further the division's commitment to support families to ensure the protection of children and the communities in which they live.

(c) Additionally, these rules, with the exception of He-C 6443.03, are intended to comply with certain requirements of the Consent Decree in the case of James O. v. Marston, et al., Civil Action No. 86-6-S, between and among Disabilities Rights Center, Inc., New Hampshire Department of Education, and New Hampshire Department of Health and Human Services as approved by the United States District Court for the District of New Hampshire on August 23, 1991.
