Section He-C 4001.26 - Independent Living Homes

(a) Independent living homes shall comply with He-C 4001.01 through He-C 4001.25, and this section, except as provided in (b) below.

(b) Independent living homes shall be exempt from:

(1) He-C 4001.21(f) (1) , regarding responsibility for the operation and maintenance of the facility;

(2) He-C 4001.17(d) , specifically regarding resident's access to cleaning products; and

(3) He-C 4001.21(g) (3) , regarding clothing requirements.

(c) Program staff shall be on site when one or more residents are on the premises.

(d) Independent living homes shall not be required to have staff in the residence when residents are not on the premises of the program, provided an effective communication system is in place to ensure that program staff are available to address the needs of the residents.

(e) Kitchen facilities shall be available and accessible for use by all residents and program staff.
