Section He-A 406.03 - Provider Termination and Suspension

(a) If an approved ATR services provider terminates its services for any reason, the provider shall submit written notification of the termination to the department 60 days prior to the termination date.

(b) The department shall terminate the provider agreement at any time by giving 30 days written notice when:

(1) ATR funding is no longer available; or

(2) The scope of the ATR program changes such that the services that current provider(s) provide are no longer covered services under the ATR program.

(c) The department shall terminate the provider agreement via written notice upon evidence of any of the following:

(1) The provider has committed fraud;

(2) The provider has abused, exploited, neglected, or extorted a client;

(3) The provider has allowed a condition to exist that jeopardizes the health, safety, or welfare of a client;

(4) The provider has failed to deliver the agreed upon services or maintain applicable provider eligibility standards; or

(5) The provider continues to not meet ATR program requirements, including, but not limited to, electronic or hard copy submission of information required by the bureau, after having received 3 remedial plans to address any such issues.

(d) BDAS shall suspend voucher reimbursement at any time via written notice upon:

(1) Reasonable indication that the provider is not in compliance with the ATR program or with any applicable local, state, or federal rule or statute; or

(2) Commencement of a BDAS investigation.

(e) The written notice in (c) and (d) above shall include:

(1) The action to be taken by the department;

(2) The reasons for the action; and

(3) The right of the provider to request a hearing in accordance with RSA 541-A, He-C 200, and He-A 406.04 prior to the termination or suspension becoming final.

(f) A provider shall be entitled to payment for all services properly rendered up to the date of termination for clients receiving services prior to the receipt of the termination notice.
