(a) In order to be eligible for the NH ATR program, an individual shall:
(1) Be a New
Hampshire resident;
(2) Be at least
18 years of age;
(3) Have screened
positive for a possible substance use disorder; and
(4) Be one of the following:
a. An individual who is:
1. An active or reservist serviceman or
servicewoman in the deployment cycle, which means being in the process of
mobilization, deployed, or in the post-deployment phase of service;
2. A veteran of Operation Enduring Freedom,
Operation Iraqi Freedom and future military operations in Iraq or
Afghanistan;
3. A member of the New
Hampshire National Guard; or
4. An
adult family member of 1., 2., or 3. above;
b. An individual convicted of a driving while
impaired (DWI) offense, except that the limitations in (b) below shall
apply;
c. An individual returning
to a New Hampshire community from a NH department of corrections (DOC)
correctional facility or program;
d. An individual who has received treatment
services from an agency contracted with the bureau; or
e. An individual referred directly by the
bureau.
(b) Eligibility for the population in (a) (4) b. above shall be limited as follows:
(1) If expenditures for services for this
population are projected to exceed the amount budgeted in any fiscal year,
eligibility shall be limited to those individuals whose gross household
personal income for the 12-month period immediately prior to the client's
applying for ATR services is at or below 200% of the most recent federal
poverty level as published annually in the Federal Register by the Secretary of
the U.S. Department of Health and Human Services;
(2) If expenditures for services for this
population provided in accordance with (1) above are projected to exceed the
amount budgeted in any fiscal year, eligibility shall be limited to those
individuals whose gross household personal income for the 12-month period
immediately prior to the client's applying for ATR services is at or below 133%
of the most recent federal poverty level; and
(3) If expenditures for services for this
population provided in accordance with (2) above are projected to exceed the
amount budgeted in any fiscal year, eligibility shall be restricted to
individuals who have completed the 7-day residential multiple DWI offender
intervention program (MOP) pursuant to
RSA
265-A:40 and whose gross household personal
income for the 12-month period immediately prior to the client's applying for
ATR services is at or below 133% of the most recent federal poverty
level.
(c) All eligible individuals shall be referred through a referral pathway described in He-A 403.02.
(d) Client participation in the NH ATR program shall be voluntary.
