(a) Live wildlife may be chained or tethered to buildings or other suitable anchorage when exhibiting wildlife as part of a presentation at a fixed facility by direct supervision of a qualified exhibitor.

(b) Elephants may be chained or tethered when exhibited as part of a mobile or fixed facility.

(c) Tethering and/or leashed wildlife shall only be allowed on the property of the permittee or with prior written consent of the facility where the wildlife is being exhibited.

(d) Written consent, on a form provided by the department, shall include:

(1) Exhibitor's name and permit number;

(2) Name of facility;

(3) Name of the person accepting responsibility for facility; and

(4) Date of the presentation.

(e) A copy of the written consent shall be kept on the person exhibiting wildlife and available for inspection by any person.
