(a) Captive wildlife shall be confined at all times in cages or enclosures.

(b) For all wildlife possessed, the permittee shall provide enclosures or cages that:

(1) Are of sufficient strength and construction to minimize risk of escape;

(2) Protect the wildlife from all other animals, domestic or wild;

(3) Protect the wildlife from the adverse elements of nature;

(4) Protect the public from contact with the wildlife; and

(5) Provide unrestricted movement required of the wildlife for proper exercise.

(c) Inadequate enclosure or cage size may be indicated by evidence of malnutrition, poor condition, debility, stress, or abnormal behavior.

(d) The permittee shall prevent the public from injuriously feeding or otherwise harming the wildlife, and shall post the necessary warning signs requiring the public to refrain from such practices.

(e) The permittee shall take precautions to protect the public from injury from permitted wildlife and to prevent any release of wildlife possessed.

(f) All cages or enclosures for the possession of wildlife shall meet or exceed minimum specifications required by this part for various kinds of wildlife.

(g) All enclosures or cages for bats shall follow the guidelines set forth in the Protocol for Wildlife Rehabilitator Response to Hibernating Bats Affected with White-Nose Syndrome (2011), as specified in Appendix II.
