Section Fis 804.07 - Prior Possession of Wildlife

(a) Any person who has legally acquired and possesses wildlife under a valid permit in 1992, and continuously since, and such wildlife is now designated as prohibited or controlled, shall be issued a permit to possess such wildlife.

(b) Any person who has legally possessed spotted turtles (Clemmys guttata), Blanding's turtles (Emydoidea blandingii), wood turtles (Glyptemys insculpta) or Eastern box turtles (Terrapene carolina carolina) prior to January 1, 1996, and continuously since, shall be issued a permit to possess wildlife. The possession permit shall be for those turtles in possession and no replacements shall be allowed.

(c) Any person who legally possessed species listed as non-controlled prior to June 1, 2007, and now listed as controlled, shall be issued a permit to possess wildlife. The possession permit shall be for wildlife in possession prior to June 1, 2007 and no replacements shall be allowed.

(d) Any person who legally possessed species listed as controlled prior to October 1, 2015, and now is classified as prohibited, shall be issued a permit to possess said species. The possession permit shall be for wildlife in possession prior to October 1, 2015 and no replacements shall be allowed, unless a waiver is issued.

(e) Wildlife possessed under permits issued pursuant to Fis 804.04 shall meet the following criteria:

(1) Wildlife shall have a permanent means of identification; and

(2) All requirements of this part shall be met.
