(a) Persons licensed to take lobster and crab pursuant to RSA 211:18 shall report lobster and crab harvest in accordance with (b) through (g).

(b) Persons who have previously reported lobster information to the executive director shall be assigned a code number and put into one of 2 groups based on previously reported landings.

(c) The groups shall be as set forth in Table 600.1:

Landing/Group Information

Group 1

Less than 1000 lbs. of lobster and crab per year and recreational permittees with 5 pots or less.

Group 2

Greater than or equal to 1000 lbs of lobster and crab per year.

(d) Those persons in Group 2 shall report the following information to the executive director by the 10th of the month for the month previous either electronically or by paper whether harvest occurred or not:

(1) On a monthly basis:
a. Name;

b. Signature of permittee subject to the penalties for unsworn false statements under RSA 641:3;

c. Lobster and crab license number;

d. Month and year;

e. Whether fishing occurred that month;

f. Total number of pots fished for the month; and

(2) On a trip basis:
a. Trip date;

b. Trip number;

c. Vessel name;

d. State vessel registration number, USCG documentation number, or National Marine Fisheries permit number;

e. Crew size;

f. Area fished;

g. Type and quantity of gear;

h. Total at-sea vessel hours;

i. Total trap soak time;

j. Quantity or weight of harvested lobster and crab by species;

k. Disposition of lobster and crab harvest;

l. Quantity and species of by catch;

m. Port, county, state landed;

n. Dealer(s) name or license number(s) harvest was sold to; and

o. Dealer(s) report serial number(s).

(e) Paper trip level reports shall be carried on the vessel and completed through the day previous.

(f) New entrants into the lobster and crab fishery and persons in Group 1 shall report by January 10th for the year previous the following monthly summarized harvest information:

(1) Name;

(2) Address;

(3) Lobster license number;

(4) Quantity of gear;

(5) Number of days pots were checked;

(6) Average number of days pot/pots fished;

(7) Quantity or weight of harvested lobster and crab by species;

(8) Area(s) fished;

(9) Average number of pots pulled;

(10) Dealer(s) name or license number(s) harvest was sold to;

(11) Dealer(s) report serial number(s);

(12) Year; and

(13) Signature of permittee subject to the penalties for unsworn false statements under RSA 641:3.

(g) Any licensee failing to report pursuant to Fis 608.01 shall not be issued a lobster and crab license pursuant to RSA 211:18 until such time that the required information is submitted. Before a license is issued, the information shall be reviewed by the department for completeness and information validated.

(h) Any resident or non-resident lobster landing or commercial saltwater licensee, pursuant to RSA 211:49-a, RSA 211:49-c, or RSA 211:49-d, landing lobster or crab in New Hampshire that does not report trip-level lobster or crab harvest to another state or federal agency shall report in accordance with Fis 608.01(d).
