No person shall tag, brand, fin clip or otherwise mark any fish taken from the freshwaters of the state prior to release of that fish back into waters of the state without first receiving either a permit to release wildlife pursuant to Fis 805.05 or a scientific license issued pursuant to Fis 1106.01. The executive director and his employees shall not be subject to this restriction while acting in the performance of their official duties.
