Once a notice of hearing has been issued in an adjudicative proceeding, the presiding officer and each participating committee member shall not communicate with any party or person concerning the merits of the case except upon notice to the other parties and an opportunity for such party or parties to participate. In accordance with the rules of this chapter, no party shall cause another person to make such communications or otherwise engage in conduct prohibited by RSA 541-A:36. Nothing shall prohibit any member of the committee from communicating with the committee's legal counsel.
