(a) The board shall request additional data or argument from the petitioner, if necessary, to clarify the argument.
(b) If the data or argument fails to support the petition, the board shall state the reason therefore in writing to the petitioner.
(c) If the data or argument supports the petition, the board shall commence rulemaking in accordance with RSA 541-A:3 except in instances where there is a valid reason for denial such as, but not limited to, lack of rulemaking authority.
