Section Esb 202.01 - Petition for Adoption, Amendment or Repeal of Rules

Any person may request the board to commence a proceeding for the purpose of adopting, amending or repealing a rule by filing a written petition that contains:

(a) A statement of the petitioner's request for the proposed rules;

(b) The text of the proposed rule or a statement of the results intended by the petitioner's interest in the subject matter of the proposed rule;

(c) An identification of the specific rule sought to be amended or repealed, if applicable;

(d) A statement whether, in regard to the petitioner, the issue which is the subject of the petition is pending in litigation;

(e) Any data or argument the petitioner believes would be useful to the board in deciding whether to commence a rulemaking proceeding; and

(f) Name and signature of petitioner, petitioner's address and the date.
