(a) For minor or major standard permit applications, the applicant shall submit a CFA report that is based on the data screening information and on-site evaluation required by Env-Wt 603.03.
(b) A CFA for tidal wetlands or tidal waters shall be:
(1)
Performed by a certified wetland scientist or qualified coastal professional;
and
(2) Completed using one of the
following methods:
a. The US ACE Highway
Methodology Workbook, dated 1993, together with the US ACE New England District
Highway Methodology Workbook Supplement, dated 1999, both available as noted in
Appendix B; or
b. An alternative
scientifically-supported method with cited reference and the reasons for the
alternative method substantiated.
(c) For any project that would impact tidal wetlands or tidal waters or associated sand dunes, the applicant shall:
(1) Use the results of the CFA to select the
location of the proposed project having the least impact to tidal wetlands,
tidal waters, or associated sand dunes;
(2) Design the proposed project to have the
least impact to tidal resources in (1), above;
(3) Where impact to wetland and other coastal
resource functions is unavoidable, limit the project impacts to the least
valuable functions, avoiding and minimizing impact to the highest and most
valuable functions; and
(4) Include
on-site minimization measures and construction management practices to protect
coastal resource areas.
