(a) This part shall apply to the construction, reconstruction, modification, repair, or replacement of a dam.
(b) This part shall not apply to activities that are part of the normal operations of a dam, such as opening and closing low level outlets.
(c) For purposes of this part, the following definitions shall apply:
(1) "C/M/R project"
means a project to construct, reconstruct, modify, repair, or replace a dam, or
any combination thereof;
(2) "Dam"
means:
a. "Dam" as defined in
RSA 482:2,
II, as reprinted in Appendix C; or
b. Any human-made barrier constructed in or
on the banks or beds of surface waters or wetlands to hold back water and raise
its level; and
(3)
"Modification" means a change to the structural components of a dam that is not
a significant expansion; and
(4)
"Significant expansion" means expansion of the footprint of an existing dam
into jurisdictional areas greater than 2 feet in width or depth.
