Section Env-Ws 342.01 - Requirements for a Variance

(a) The department shall grant a variance to a public water system from a requirement respecting an applicable MCL established by Env-Ws 300 upon finding that:

(1) Because of characteristics of the raw water sources which are reasonably available to the system, the system cannot meet the requirements respecting the MCLdespite application of the best technology, treatment techniques, or other means;

(2) The granting of a variance shall not result in an unreasonable risk to the health of persons served by the system; and

(3) The variance is not prohibited by 40 CFR 141.4(a).

(b) The department shall grant a variance to a public water system from a requirement of anapplicable specified treatment technique upon a finding that the public water system applying for the variance has demonstrated that such treatment technique is not necessary to protect the health of persons because of the nature of the raw water source of such system.
