(a) Public water systems that receive approval to use bottled water as a condition for receiving a variance or an exemption from the requirements of Env-Ws 310 through Env-Ws 316 shall meet the following requirements:
(1) The
departmentshall require and approve a monitoring program for bottle water based
on requirement inEnv-Ws 320 through Env-Ws 329. The public water system shall
develop and put in place a monitoring program that assures that the bottled
water meets all MCLs;
(2) The
public water system shall monitor a representative sample of the bottled water
for all contaminants in Env-Ws 310 through Env-Ws 316 during the first quarter
that it supplies the bottled water to its customers, and annually thereafter.
The public water system shall provide the results of the monitoring program to
the department within 10 days after the beginning of the first quarter in which
bottled water is provided and annually thereafter; or
(3) The public water system shall receive a
certification from the bottled water company that the bottled water supplied
has been taken from a "NH-approved source of bottled water" and the bottled
water does not exceed any MCLs. The public water system shall provide the
certification to the department within 10 days after the beginning of the first
quarter in which bottled water is provided and annually thereafter.
(b) The public water system shall provide sufficient quantities of bottled water to every person supplied by the public water system, via door-to-door bottled water delivery.
