Section Env-Wq 1010.15 - Use of Existing Stock of Non-Conforming Septic Tanks

(a) Any manufacturer of septic tanks who has septic tanks in stock that do not conform to the requirements of the 2011 amendments to Env-Wq 1010 on the effective date of the 2011 amendments may continue to sell the non-conforming septic tanks if:
(1) The manufacturer submits a written
request to the department, stating the total number of non-conforming tanks in
stock and the reason(s) for the non-conformity; and
(2) The designer specifies on the plan
submitted for approval that a non-conforming tank may be used.
(b) No plan submitted for a system that will be installed after January 1, 2012 shall specify that a non-conforming tank may be used.
