(a) Before transporting or offering hazardous waste for transportation off-site, a generator shall:
(1) Package the waste in US DOT containers as
specified in 49 CFR 173, 178, and 179;
(2) Mark and label each container in
accordance with the applicable US DOT hazardous materials regulations in 49 CFR
Part 172; and
(3) Mark each
container of 119 gallons or less in accordance with
49 CFR
172.304, including the following:
a. The generator's name and physical
address;
b. The generator's EPA
identification number;
c. The
manifest tracking number; and
d.
The following statement: "HAZARDOUS WASTE - Federal Law Prohibits Improper
Disposal. If found, contact the nearest police or public safety authority or
the U.S. Environmental Protection Agency".
(b) Before transporting or offering hazardous waste for transportation off-site, a generator shall determine that:
(1) The transporter possesses a current and
valid New Hampshire hazardous waste transporter registration and an EPA
identification number; and
(2) The
transport vehicle is placarded in accordance with US DOT regulations for
hazardous materials under 49 CFR 172, subpart F and rules adopted by the New
Hampshire department of safety.
