(a) The person requesting the rule waiver shall provide the following information:
(1) The name, address, and daytime telephone
number of the person requesting the waiver;
(2) Identification of the specific rule(s)
from which the applicant is seeking a waiver;
(3) The period of time during which the
applicant wishes the waiver to be effective;
(4) A description of the specific project(s)
to which the waiver is intended to apply or a statement that the requested
waiver is intended to apply without regard to a specific project(s);
(5) A full explanation of why the waiver is
necessary, including an explanation of the economic and operational
consequences of complying with the rule as written;
(6) A full explanation, with supporting data,
of the alternative(s), if any, that the applicant proposes to use in lieu of
complying with the rule;
(7) A full
explanation of how each of the alternatives proposed pursuant to (6) above, is
consistent with the purpose and intent of RSA 141-E and Env-A 1800, and is
otherwise adequate to protect public health, safety and the environment;
and
(8) A list of all state and
federal enforcement actions, both past and pending, against the applicant,
including responsible persons in its employ, with regard to environmental,
health or safety activities, and the current status of each such enforcement
action.
(b) Each request for waiver shall be dated and signed by the applicant as specified in Env-A 1810.06.
