(a) A student shall be eligible classified for purposes of the New Hampshire UEAP if he or she has been a resident of the state for 12 consecutive months immediately preceding the term for which in-state status is awarded.

(b) No person shall be eligible for in-state status unless his or her residence in New Hampshire is for some purpose other than the temporary or primary one of obtaining an education.

(c) In all cases of application for in-state status for UEAP purposes, the burden of proof shall be on the applicant.

(d) No unemancipated person shall be eligible for in-state status unless his or her parents have established a domicile in this state.
