Section Arb 204.08 - Decision of the Board

(a) For the purpose of rendering a decision, 3 members of the board shall constitute a quorum.

(b) The board shall determine whether the consumer or lessee is entitled to a refund or replacement pursuant to RSA 357-D:4,VI.

(c) All decisions shall be reached on the basis of a preponderance of the evidence.

(d) The decision shall be in writing and set forth findings of fact, conclusions of law and a final disposition.

(e) The decision of the board shall be rendered within 30 days of the conclusion of the hearing pursuant to RSA 357-D:5,IV.

(f) In those cases in which a vehicle is determined to have a serious safety defect pursuant to RSA 357-D:12, the board shall state in its decision that the vehicle shall not be resold in New Hampshire, pursuant to RSA 357-D:12, II.

(g) If a vehicle is determined to have a serious safety defect pursuant to (f) above, the board shall notify the department of safety, division of motor vehicles, title bureau, by forwarding it a copy of the board's decision.

(h) The decision shall be mailed to the parties.
