(a) The department shall conduct farm inspections pursuant to RSA 426-A:4.
(b) Initial inspections shall be conducted:
(1) On farms whose farming practices include
covered activity as defined in 21 C.F.R. Part 112.3, 2016;
(2) As the first regulatory inspection
activity to evaluate compliance with applicable regulations;
(3) With afocus on education unless egregious
conditions are observed; and
(4)
When covered produce is being grown, harvested, packed, or held for
distribution.
(c) Routine inspections shall be conducted:
(1) On farms
whose farming practices include covered activity as defined in 21 C.F.R. Part
112.3, 2016;
(2) When covered
produce is being grown, harvested, packed, and held for distribution;
and
(3) Once every 3 years on or
after the date of initial inspection.
(d) Follow-up inspections shall be conducted:
(1) To review changes in farming practices,
or recordkeeping, on a farm, when noncompliance was noted during a routine
inspection; and
(2) Within 30 days
from the date received, of a written notification to the farm.
(e) For-cause inspections shall be conducted in response to a specific issue or produce safety concern, such as an outbreak, reported complaint, or recall.
