Section 706.4015 - Administrative fines: Powers and duties of hearing officer

1. A hearing officer shall:
(a) Subscribe to the constitutional oath of
office before exercising any of the powers or performing any of the duties of
his or her office.
(b) Conduct a
fair and impartial hearing in accordance with the law.
(c) Conduct the entire hearing on the record
and require each party or the party's counsel to identify himself or herself
before presenting evidence.
(d)
Establish the order of presentation of the evidence by each party.
(e) Ensure that the hearing proceeds with
reasonable diligence and the least delay practicable.
(f) Prepare a proposed decision for review by
the Authority.
(g) Deliver the
record of the hearing and the proposed decision to the Authority.
2. If not otherwise prohibited by law and if substantial rights of the parties will not be prejudiced, a hearing officer may allow amendment of the complaint and answer before conducting a hearing.
