If a small-scale provider of last resort believes that its compliance with NAC 703.27128 to 703.27146, inclusive, would be impracticable or unnecessary because of factors which are unique to its application, the small-scale provider of last resort must apply to the Commission for a variance from those provisions accompanied by justification for the deviation.
