Section 616C.558 - Plan for program of vocational rehabilitation

1. If an insurer or third-party administrator determines that an injured employee is eligible for vocational rehabilitation services, the insurer or third-party administrator shall, within 60 days after making that determination, submit to the treating or examining physician or chiropractor a written plan for a program of vocational rehabilitation that includes the characteristics of physical demand for the occupational goal for the injured employee.

2. A treating or examining physician or chiropractor shall, within 10 days after receiving a plan for a program of vocational rehabilitation, provide the vocational rehabilitation counselor with a written approval or denial of the plan that includes the rationale for the approval or denial and a determination of the medical capability of the injured employee safely to achieve the occupational goal set forth in the plan.

3. A plan for a program of vocational rehabilitation must be approved in writing by the treating or examining physician or chiropractor before the program may be commenced.
