1. The Department may suspend a license issued pursuant to section 13 if:

(a) The Department has reason to believe that an imminent public health hazard exists.

(b) The custom processing establishment or mobile processing unit of a licensee is insanitary such that any carcass processed at the establishment or unit would be adulterated or contaminated.

(c) A licensee interferes with the performance of the duties of the Department.

(d) A licensee violates any provision of this chapter.

(e) A licensee has not made a custom processing establishment or mobile processing unit available for inspection upon a reasonable request from the Department.

(f) A licensee has not corrected a violation by the date set forth in the written warning issued pursuant to section 28.

(g) The Department finds insanitary conditions, insanitary practices, adulterated products or misbranded products in a custom processing establishment or mobile processing unit that violate the Poultry Products Inspection Act, 21 U.S.C. §§ 451 et seq. The suspension of a license pursuant to this paragraph must comply with the applicable rules of practice set forth in 9 C.F.R. Part 500.

2. If a license is suspended pursuant to subsection 1, the Department shall notify the licensee in writing. The notice must include a statement informing the licensee that he or she may request a hearing pursuant to subsection 3.

3. Any licensee whose license is suspended pursuant to subsection 1 or a licensee who is issued a written warning pursuant to section 28 may request in writing a hearing before the Department.

4. A licensee whose license is suspended pursuant to subsection 1 may apply to the Department for reinstatement of the license. The Department shall reevaluate the applicant and determine whether the applicant has corrected the violations that were the basis for the suspension. The Department may charge the applicant a reinstatement fee of $250. Upon payment of the fee and approval from the Department, the Department shall reinstate the license.
