MEAT AND POULTRY INSPECTION
Section 583.490 - Seizure and condemnation

1. Any carcass, part of a carcass, meat or meat food product of cattle, sheep, swine, goats, horses, mules or other equines, poultry or poultry food product, or any dead, dying, disabled or diseased cattle, sheep, swine, goat, equine or poultry, that is being transported in intrastate commerce, or is held for sale in this State after transportation and that:

(a) Is or has been prepared, sold, transported or otherwise distributed or offered or received for distribution in violation of NAC 583.211 to 583.530, inclusive, and sections 2 to 29, inclusive;

(b) Is capable of use as human food and is adulterated or misbranded; or

(c) In any other way is in violation of NAC 583.211 to 583.530, inclusive, and sections 2 to 29, inclusive, may be proceeded against and seized and condemned, by any court of competent jurisdiction.

2. If the article or animal is condemned, it must, after entry of the decree, be disposed of by destruction or sale as the court may direct.

3. In no case may the article or animal be sold contrary to the provisions of NAC 583.211 to 583.530, inclusive, and sections 2 to 29, inclusive, the Federal Meat Inspection Act, the Poultry Products Inspection Act or the Federal Food, Drug and Cosmetic Act.

4. The provisions of this section do not limit the authority for condemnation or seizure conferred by other provisions of NAC 583.211 to 583.530, inclusive, and sections 2 to 29, inclusive, or other laws.
