Section 535.330 - Grounds for revocation of approval to impound

The State Engineer may revoke an approval to impound, including a temporary approval to impound, if:
1. The approval is based on a water right that is moved, cancelled, denied, withdrawn or forfeited.
2. The terms of the approval to impound are violated.
3. The dam is operated in an unsafe manner.
4. The dam is damaged to such an extent that, in the opinion of the State Engineer, failure of the dam is reasonably possible.
5. The file associated with the dam is closed pursuant to NAC 535.290.
