Section 504.440 - Mitigation of damages required

Each claimant shall mitigate damages where possible. A claim may be denied or limited if the claimant fails to exercise reasonable care and diligence to avoid the loss or to minimize or lessen damage. The burden of proving a failure to mitigate damages rests with the Department.
