FUND FOR BROWNFIELD PROJECTS
General Provisions
Section 459.99916 - "Eligible entity" defined

"Eligible entity" has the meaning ascribed to it in 42 U.S.C. § 9604(k)(1), except that the term:
1. Includes a nonprofit organization; and
2. Does not include:
(a) A government entity created by a
state legislature;
(b) An Alaska
Native Regional Corporation or an Alaska Native Village Corporation, as defined
in the Alaska Native Claims Settlement Act,
43 U.S.C.
§§
1601 et seq., or the Metlakatla
Indian Community; or
(c) Any person
who is otherwise ineligible to receive a loan from the Fund pursuant to NAC
459.99924.
