POISONOUS AND TOXIC MATERIALS
Section 446.619 - Use and application

1. Poisonous or toxic materials must be:
(a) Used according
to:
(1) The manufacturer's use directions
included in the labeling and, for a pesticide, the manufacturer's label
instructions which state that use is allowed in a food establishment;
and
(2) The conditions of
certification, if certification is required, for use of the pest control
materials; and
(b)
Applied so that:
(1) A hazard to employees or
other persons is not constituted; and
(2) Contamination, including, without
limitation, toxic residues because of drip, drain, fog, splash or spray on
food, equipment, utensils, linens, and single-service and single-use articles,
is prevented, which, for a restricted-use pesticide, must be achieved by:
(I) Removing the items;
(II) Covering the items with impermeable
covers or taking other appropriate preventive actions; and
(III) Cleaning and sanitizing equipment and
utensils after the application.
2. A restricted-use pesticide must meet the requirements specified under 40 C.F.R. Part 152, Subpart I, "Classification of Pesticides," and must be applied only by a person licensed in Nevada.
3. As used in this section, "restricted-use pesticide" means a pesticide product that is limited to use by or under the direct supervision of a certified applicator, or as defined in NRS 586.205.
