The Department shall conduct an antidegradation review to ensure the antidegradation requirements of sections 3 to 19, inclusive are met if a person submits an application for a permit pursuant to NAC 445A.230 for:
1. A new point source discharge;
2. The renewal or modification of a permit that will result in an expanded point source discharge, which includes, without limitation, a proposed:
(a) Increase of the
maximum flow of the discharge;
(b)
Increase in the concentration of any parameter of concern in the
discharge;
(c) Increase in the load
of any parameter of concern to the receiving water;
(d) Change in the composition of the
discharge which would require different effluent limitations; or
(e) Relocation of the discharge; or
3. A new or altered zone of mixing.
