Section 445A.54294 - Issuance of emergency order

1. If the Bureau determines that any facility, equipment, operation or other condition of a certified laboratory requires immediate action to protect the health and safety of the members of the general public and the Bureau receives the approval of the Administrator of the Division of Environmental Protection of the State Department of Conservation and Natural Resources, the Bureau may, without notice or hearing, issue an emergency order:
2. An emergency order is effective upon issuance and is not subject to review unless, within 30 days after the date the order is served, the person to whom the Bureau issues the order petitions for a hearing before the Commission.
3. The Commission shall continue, modify or revoke the emergency order within 30 days after it conducts the hearing required by the provisions of subsection 2.
