Section 444.9525 - Notice of intent to terminate permit

When the Director decides to terminate a permit for the management of waste containing polychlorinated biphenyl the Director shall issue a notice of his or her intent to terminate and follow the same procedure as for a draft permit. The following are causes for terminating a permit during its term or for denying renewal:

1. Noncompliance by the permittee with any condition of the permit;

2. The permittee's misrepresentation or failure to disclose fully all relevant facts; or

3. A determination by the Director that the permitted activity endangers human health or the environment and can only be returned to acceptable levels by modification or termination.
