Section 439.210 - Application to State Board of Health

1. An application to the State Board of Health for a variance must be:
(a) Submitted in writing to the Secretary of
the Board at the Division of Public and Behavioral Health of the Department of
Health and Human Services, Carson City, Nevada.
(b) Except as otherwise provided in
subsection 3, accompanied by a payment of the actual cost to provide public
notice of the application and notice of the date of the public
hearing.
2. The Division of Public and Behavioral Health of the Department of Health and Human Services shall:
(a) Update, at least quarterly, the
actual cost to provide public notice of the application and notice of the
public hearing for purposes of paragraph (b) of subsection 1; and
(b) Post the information on the website of
the Division.
3. The Secretary of the Board may waive the requirement that the applicant pay the costs set forth in paragraph (b) of subsection 1 upon a showing of extreme economic hardship.
