ADMINISTRATIVE HEARINGS BEFORE STATE BOARD OF HEALTH
Section 439.190 - Request for administrative hearing; contents of request; scheduling and notice of hearing; procedures at hearing

1. Except as otherwise provided in this section, in any administrative hearing that the State Board of Health is required to hold, the procedures for hearing officers set forth in NAC 439.300 to 439.395, inclusive, apply.
2. In any administrative hearing that the State Board of Health is required to hold:
(a) A request for a hearing must be addressed
to the Administrator as the Executive Secretary of the Board and must be
received within the period prescribed by statute or regulation. The request
must specify the reasons that the appellant is requesting a hearing.
(b) Upon receipt of the request for a
hearing, the Executive Secretary shall schedule the matter to be heard at a
public hearing held:
(1) At the next
regularly scheduled meeting of the Board;
(2) At the next meeting of the Board held in
Las Vegas or Reno, as requested by the appellant; or
(3) As soon thereafter as the schedule of the
Board allows.
(c)
Written notice of the date of the hearing must be served by personal delivery
to the appellant or by mailing the notice by registered or certified mail to
the last known residential or business address of the appellant.
