Section 388.219 - Provision of services to pupils with disabilities who are homeschooled or enrolled by their parents in private schools

To the extent consistent with the number and location of pupils with disabilities who are homeschooled or enrolled by their parents in private elementary and secondary schools, including, without limitation, religious schools, and who are located in the school district , each school district shall provide for the participation of those pupils in the program assisted or carried out under Part B of the Individuals with Disabilities Education Act, 20 U.S.C. §§ 1411 et seq., by providing those pupils with special education and related services in accordance with the provisions of 34 C.F.R. §§ 300.130 to 300.144, inclusive , including, without limitation, direct services determined in accordance with the provisions of 34 C.F.R. § 300.137.
