Section 388.191 - Biological or adoptive parent or person identified in judicial decree or order deemed to be parent of pupil under certain circumstances

1. Except as otherwise provided in this section, when more than one person may act as the parent of a pupil, as defined in NAC 388.071, the biological or adoptive parent of the pupil shall , when attempting to act as the parent of the pupil for the purposes of NAC 388.001 to 388.450, inclusive of this regulation, and sections 2 to 10, inclusive, be deemed the parent of the pupil unless that person does not have the legal authority to make educational decisions for the pupil.

2. If a judicial decree or order identifies more than one person to act as the parent of a pupil or to make educational decisions for the pupil , the persons identified in the judicial decree or order shall be deemed the parents of the pupil for the purposes of NAC 388.001 to 388.450, inclusive , and sections 2 to 10, inclusive, of this regulation.
