1. If a report compiled pursuant to NAC 228.460 or section 11 of this regulation indicates that a violation has occurred, the program that is the subject of the report shall, not later than 10 days after the report is made available to the program, submit to the Division a plan of correction for each violation. The plan of correction must include specific actions that will be taken to correct the violation, the date by which such actions will be taken and the name and title of the employee or independent contractor of the program who is responsible for ensuring that the plan is implemented. Failure to submit a timely plan of correction constitutes a separate violation for which additional disciplinary action may be imposed.

2. If the Division determines that a plan of correction is:

(a) Acceptable, the Division will notify the program that submitted the plan of correction that the plan of correction has been approved; or

(b) Not acceptable, the Division may require the program that submitted the plan of correction to:
(1) Submit a revised plan of correction; or

(2) Comply with a plan of correction prescribed by the Division.
