Section 474-1-012 - ASSIGNMENT OF PAYEE, GUARDIANSHIP OR CONSERVATOR STATUS

No employee of the Department shall serve as a protective payee, guardian or conservator for any recipient when the employee
(A) Determines eligibility;
(B) Authorizes services;
(C) Provides direct service; or
(D) Has any other professional relationship which may be considered a conflict of interest.
012.01 DEPARTMENT EMPLOYEE AS PROTECTIVE PAYEE. A service worker may act as protective payee for a recipient only if the employee does not determine eligibility for a categorical program for that recipient. All other community resources must be explored before a services worker may accept the payee assignment.
