Section 180-4-019 - PUBLIC NOTIFICATION AND PUBLIC PARTICIPATION

The process for public notification and participation in the Department's consideration of license termination under restricted and alternate conditions is as follows.

019.01 COMMENTS. Upon the receipt of the decommissioning plan from the licensee, or a proposal by the licensee for release of a site according to 180 NAC 4-017 and 4-018, or whenever the Department deems such notice to be in the public interest, the Department may:

(A) Notify and solicit comments from:
(i) Local and State governments in the vicinity of the site and any Indian Nation or other indigenous people that have treaty or statutory rights that could be affected by the decommissioning; and

(ii) The Environmental Protection Agency for cases where the licensee proposes to release a site according to 180 NAC 4-018.

019.02 PUBLICATION. A notice may be posted in local newspapers, letters to the State or local organizations, or other appropriate forum, that is readily accessible to individuals in the vicinity of the site, and comments may be solicited from affected parties.
